School District Named in Personal Injury Lawsuit

A personal injury lawsuit has been filed against a school district putting some of the blame for a sexual relationship between instructional aide and student on district officials.

The lawsuit filed last week, in Riverside County Superior Court, seeks more than $25,000 in damages and names the school district and former instructional aide as defendants.

The aide charged with three counts of unlawful sexual intercourse with a minor, later pled to one count, according to court records. He was sentenced to 120 days in jail.

He was fired immediately after his arrest in June 2006. The lawsuit blames campus officials.

"(The student) would leave home from school with (instructor) at the end of the school day, without first going home to her own residence," the lawsuit states. "The school district was negligent in that they failed to maintain proper supervision of (the student) while she was still in school custody."

Officers arrested him after they were notified by the girl's parents that their daughter may have been engaged in a sexual relationship with a school district employee. The parents had come to that conclusion after she returned home after spending several days with the instructor, Temecula police had said.

He agreed to cooperate with detectives, and it was discovered that he had a relationship with the then-16-year-old girl that included overnight trips and unlawful sexual activity at or near his home in Rialto, police said.
